Terms & Conditions

1. About These Terms

These Terms & Conditions ("Terms") govern your use of the Talentcare International website and your engagement of any service offered by Talentcare International ("Talentcare", "we", "us", "our"), a Sri Lankan HR consulting firm operating from 85/2B Baptist Avenue, Madiwela, Kotte, Sri Lanka. By using this website, submitting an enquiry, or engaging our services, you agree to these Terms.

2. Our Services

Talentcare provides:

  • HR consulting and research services for organizations, including but not limited to the services described on our What We Do page (e.g. mystery customer surveys, HR audits, training, coaching, exit and post-exit surveys, cultural audits, and succession planning);
  • individual services including Dream Setting consultations, aspiration-prioritizing mentorship, and support through career threats and obstacles, described on our For Individuals page;
  • the Individual Development Programme, a paid career-development package for individuals; and
  • referrals to independent legal advisors for workplace legal matters raised by individual clients.

Some services are offered free of charge (such as an initial consultation), while others are chargeable. Where a service is chargeable, the fee and scope will be confirmed with you in writing (by email or quotation) before work begins.

3. Engagement Basis

For organizational engagements, the specific scope of work, timeline, and deliverables will be set out in a proposal, quotation, or engagement letter agreed between Talentcare and the client before work commences. Work outside that agreed scope may be treated as a separate, additionally chargeable engagement. For individual services, the scope of a paid consultation or programme (such as the Individual Development Programme) will be confirmed with you before payment is taken.

We act as an independent consultant in every engagement, not as an employee, agent, or partner of the client, unless separately agreed in writing.

4. Payment Terms

Fees for chargeable services are quoted in Sri Lankan Rupees (LKR) unless otherwise agreed. Payment terms (including deposits, milestone payments, or full upfront payment) will be specified in the relevant quotation or invoice.

Where online payment is available, payments are processed through PayHere, a licensed Sri Lankan payment gateway. Talentcare does not receive or store your card or bank details directly — these are handled by PayHere and its banking partners. See our Privacy Policy for more on how payment data is handled.

Invoices are payable by the due date stated on the invoice. Talentcare reserves the right to pause or withhold delivery of a service where payment is overdue.

5. Intellectual Property

Talentcare retains ownership of its proprietary research methodologies, survey instruments, frameworks, templates, and general know-how used in delivering any service, whether developed before or during an engagement.

Upon full payment for a specific engagement, the client is granted the right to use the final research findings, reports, and deliverables produced specifically for that engagement, for the client's own internal business purposes. Talentcare may reference the existence of a completed engagement (without disclosing confidential findings) for its own marketing purposes unless the client requests otherwise in writing.

6. Confidentiality

Talentcare treats information shared by clients — including survey responses and HR data — as confidential, and uses it only for the purpose it was provided for, as further described in our Privacy Policy.

7. Limitation of Liability

Talentcare provides its services with reasonable skill and care, based on the information made available to us. However, to the fullest extent permitted by Sri Lankan law, Talentcare's total liability arising from any engagement is limited to the fees actually paid by the client for that specific engagement, and Talentcare is not liable for indirect, incidental, or consequential loss (including loss of profit, business, or goodwill) arising from the use of our research, advice, or services.

Talentcare's role in referring individual clients to independent legal advisors is limited to the referral itself; we are not responsible for the advice given by, or the conduct of, any independent third-party advisor.

8. Website Use

This website and its content are provided for general information about Talentcare's services. We aim to keep information accurate and up to date but do not guarantee that the website will be error-free or uninterrupted at all times.

9. Governing Law

These Terms are governed by the laws of Sri Lanka, and any dispute arising out of or in connection with these Terms or our services will be subject to the exclusive jurisdiction of the courts of Sri Lanka.
